TCPA — Telephone Consumer Protection Act

The Telephone Consumer Protection Act requires "prior express written consent" before sending autodialed or prerecorded marketing calls and texts. For a website, the compliance surface is lead-generation and SMS opt-in forms: they must carry the required consent disclosures and capture an affirmative, unchecked opt-in. Damages are $500 per violation, trebled to $1,500 for willful violations.
